Terms of Service
“AR-TY”, a platform as a service (PAAS) that provides in-browser 3D model viewer services to its clients. The following Terms of Service govern the use of our services and the relationship between you, the client, and “AR-TY”.
Definitions
“Client” or “you” refers to the person or entity using the services provided by “AR-TY”. “Services” refers to the in-browser 3D model viewer services provided by “AR-TY”. “Models” refers to the 3D models uploaded by the client and viewed through the Services. “Terms” refers to these Terms of Service.
Service Provision
“AR-TY” provides the Services to the Client for the purpose of viewing 3D models in a web browser. The Services are provided on an as-is basis and “AR-TY” does not guarantee that the Services will be uninterrupted or error-free. “AR-TY” reserves the right to modify or discontinue the Services at any time without notice.
Models
The Client is solely responsible for the Models and their content. “AR-TY” does not claim ownership of the Models and will not use the Models for any purpose other than providing the Services to the Client. The Client represents and warrants that it has the right to use the Models and their content and that the use of the Models and their content does not infringe the rights of any third party.
Intellectual Property
“AR-TY” retains all right, title, and interest in and to the Services and any technology used to provide the Services. The Client will not reverse engineer, decompile, or disassemble the Services or technology used to provide the Services.
Disclaimers
THE SERVICES ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. “AR-TY” DOES NOT WARRANT THAT THE SERVICES WILL MEET THE CLIENT’S REQUIREMENTS OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of Liability
IN NO EVENT WILL “AR-TY” BE LIABLE FOR ANY DAMAGES INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR SIMILAR DAMAGES, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICES OR THE MODELS.
Indemnification
The Client will indemnify and hold “AR-TY” harmless from any and all claims, damages, and expenses (including, without limitation, reasonable attorneys’ fees) arising from the Client’s use of the Services and Models.
Termination
Either party may terminate these Terms at any time with written notice to the other party. Upon termination, the Client will no longer have access to the Services and the Models will be deleted.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Serbia. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the courts of Serbia.
